My Vincinity Terms and Conditions

TERMS AND CONDITIONS
1. Only residents of the Republic of South Africa above the age of 18 are eligible to join the programme and use the Card.
2. A contractual relationship on the terms and conditions set out in these terms and conditions will come into existence and by signing the application form, the Member shall be deemed to have accepted such terms and conditions.
3. These Terms and Conditions are subject to change without notice.
4. Members earn loyalty points when purchasing goods or services which are not on Special Promotion or marked as being excluded from the Loyalty/Rewards Programme.
5. To receive loyalty points when purchasing goods or services, the Member must produce his card at a Loyalty/Rewards Terminal.
6. Points earned are not transferable and not redeemable for cash.
7. The Vincinity Card is issued by and remains the property of OMIGPI Vincent Park or any of its associated marketing companies – Primedia Lifestyle. OMIGPI Vincent Park reserves the right to decline, issue and withdraw the Vincinity Card at any time.
8. By signing these Terms and Conditions, the Member agrees to receive communication from OMIGPI Vincent Park and/or Primedia Lifestyle, in accordance with Section 45 of the Electronic Transactions and Communications (ECT) Act, 25 of 2002 as may be amended form time to time.
9. The Vincinity Card may be used at all scanning OMIGPI Vincent Park retail outlets, and OMIGPI Vincent Park Pharmacies and such affinity partners as may be specified by OMIGPI Vincent Park from time to time.
10. Your Vincinity Card may not be used as a credit, debit or guarantee card.
11. The Vincinity Card is not transferable.
12. The owners of Vincent Park Shopping Centre, its managing agents and Primedia Lifestyle reserves the right to make certain promotional events exempt from earning loyalty Points.
13. Rewards may ordinarily be collected monthly at designated collection points at Vincent Park Shopping Centre, but may said times may vary at OMIGPI Vincent Park’s sole and absolute discretion.
14. The nature of the reward will be based on the total number of Vincinity Card Loyalty Points that a Member has earned and accumulated by the end of the last day of each collection period.
15. The redemption value of Loyalty Points as explained herein may change at any time at the discretion of OMIGPI Vincent Park management. A change shall not affect Vincinity Card Loyalty Points issued prior to the date of change.
16. Vincinity Card Loyalty Points are not earned on purchases of OMIGPI Vincent Park gift vouchers and cannot be exchanged for OMIGPI Vincent Park gift vouchers.
17. OMIGPI Vincent Park reserves the right to alter or amend the conditions of operation of the Vincinity Card scheme, or to terminate the scheme at any time without notice.
18. Any abuse of the Vincinity Card by any person whatsoever may result in the cancellation of the card and the forfeiting of any loyalty points which may have become due as a result of such abuse.
19. Upon receipt of telephonic and written advice of the loss or theft of a card the use of the card shall be suspended together with the Rewards relating thereto. If the card is located within 3 (three) months, the Rewards will be released and use of the card may resume. If the card is not located within such period the card will be cancelled and the Rewards concerned shall be forfeited. The Member accepts liability for and indemnifies Vincent Park Shopping Centre and its owners and their agents against any loss, cost and expense that they may sustain from the use of a lost or stolen card.
20. The owners of Vincent Park Shopping Centre and its managing agents shall not be liable to any Vincinity Card Holder Member for:
  1. any consequential or other damages, whether direct or indirect, associated with the Loyalty/Rewards Programme;
  2. termination or suspension of the Loyalty/Rewards Programme;
  3. inability to credit or debit Rewards due to circumstances beyond its control, such as for example Loyalty/Rewards Terminals being off line;
  4. any delay in replacing a lost or stolen card or any unauthorised use of a card;
21. The owners of Vincent Park Shopping Centre and its managing agents give no warranties nor accepts liability, of nature whatsoever, for any claims, loss or damage from any cause arising out of or in connection with the supply of goods and services related in any way to the Loyalty/Rewards Programme.
22. Cards are not transferable, remain the owners of Vincent Park Shopping Centre and its managing agent’s property.
23. Cards and/or rights which the Cards confer may not be alienated, sold, transferred, pledged, assigned or dealt with in any other manner except as set out in these terms and conditions.

COMPETITIONS
1. Competitions held in terms of the Loyalty/Rewards Programme are only open to residents of the Republic of South Africa.
2. Only current Vincinity Card Holders may enter competitions.
3. Employees of the owners of Vincent Park Shopping Centre and its managing agents, and those of associated companies and Merchants and promotional partners, their agents and their families may not enter competitions.
4. Entries are free and without obligation except for adherence to the rules.
5. A Vincinity Card Holder may submit only one entry.
6. Only legible and complete entries will be accepted.
7. The right is reserved to alter the prize by substituting one of equivalent value.
8. Prize Winners will be chosen randomly within 4 (four) months of the closing date of the competition concerned.
9. The owners of Vincent Park Shopping Centre and its managing agents' decision on the selection method for choosing the prize winners shall be final and no correspondence will be entertained.
10. Prizes shall be accepted in the form awarded, may not be transferred and may not be exchanged for cash or credit.
11. Prizes not claimed within 90 (ninety) days of the date written notice is despatched to the winners thereof shall be forfeited.
12. The owners of Vincent Park Shopping Centre and its managing agents may from time to time, in its sole discretion, amend the rules relating to competitions.
13. It is a standard condition of entry that participants agree to receive future correspondence from the relevant competition partner / sponsor. This could take the form of email newsletters and / or sms communications and / or loyalty programme registration documentation and / or information.
14. Anyone can unsubscribe from these communications at any time by contacting OMIGPI Vincent Park or following the unsubscribe link on the communication. Any difficulties can be emailed to unsubscribe@vincentpark.co.za.
15. The competition partner / sponsor adheres to and acts in accordance with Section 45 of the Electronic Transactions and Communications (ECT) Act, 25 of 2002 as a policy of operation. The competition partners / sponsors do not support the proliferation of spam or unsolicited communications. The competition partners /sponsors will not purposefully neglect to unsubscribe a person who has requested it, nor will The competition partners / sponsors trade or supply user information to third parties that are not directly involved in the campaign.
16. The competition partners / sponsors not accept responsibility for circumstances out of its control or unforeseen systems errors which may interfere with the immediate process of unsubscribing. Any difficulties can be emailed to unsubscribe@vincentpark.co.za
17. The submission of an entry in any competition shall be deemed to be acceptance of these terms and conditions and any other conditions imposed in respect of the competition concerned.
GENERAL
1. The owners of Vincent Park Shopping Centre and its managing agents and employees shall not be eligible for membership.
2. Only the owners of Vincent Park Shopping Centre and its managing agents may alter or vary these terms and conditions. Any such alteration or variation shall be reduced to writing and be valid and effective when signed by a duly authorised representative of the owners of Vincent Park Shopping Centre or its managing agents.
3. Any indulgence granted by the owners of Vincent Park Shopping Centre and its managing agents to any Member shall not constitute a waiver of its rights against the Member and the owners of Vincent Park Shopping Centre and/or its managing agents shall not thereby be precluded from exercising its rights against any Member concerned, whether having arisen in the past or arising in the future.
4. The owners of Vincent Park Shopping Centre and its managing agents reserves the right without prior notice to Members to amend, including the right to amend the ratio of Loyalty/Rewards Points to purchases, and to terminate the Loyalty/Rewards Programme.
5. The information contained in these terms and conditions are provided for general information only and do not constitute any form of advice. The owners of Vincent Park Shopping Centre and its managing agents accepts no responsibility for the accuracy of any particular statement nor accepts liability for any loss, cost or expense which may arise from reliance on the information contained in these terms and conditions.
